The IRS accepts fax for Form SS-4 (EIN applications), Form 2553 (S corporation election), Forms 2848 and 8821 (authorizations), and Form 3115 among others — with published fax numbers and current instructions as of 2026. A firm handling client financial data also carries obligations under the Gramm-Leach-Bliley Safeguards Rule.

Questions worth asking.
Usually not — HIPAA applies to health information, not financial records. The exception is a firm doing work for a healthcare client that exposes it to patient data, which makes it a business associate for that engagement. Most accounting firms need the security, the audit trail and GLBA compliance rather than a BAA. Ours is included either way.
If you transmit protected health information, yes — and that requires a signed Business Associate Agreement with your fax provider.
