A law firm handling protected health information on behalf of a covered entity is a business associate under 45 CFR 160.103 and must sign a BAA with that client — and with any vendor that touches those records on the firm's behalf, including the fax service. It does when the firm handles protected health information for a covered entity — personal injury, medical malpractice, disability, workers' compensation.
